Forest Hills Stadium Lawsuit Reaches Resolution

Forest Hills Gardens Corporation, West Side Tennis Club, and Tiebreaker Productions have resolved their ongoing litigation regarding future events at Forest Hills Stadium in Queens. Forest Hills Gardens Corporation (FHGC), the owner of the stadium’s land, had filed a lawsuit in 2023 against West Side Tennis Club (WSTC) and Tiebreaker Productions, organizations that own and operate the venue, respectively.

The original lawsuit included seven different complaints raised by FHGC. These issues included complaints about the noise and litter generated by concerts at the venue. After Justice Joseph Esposito dismissed five of the seven claims in Oct. 2024, the only issues remaining were claims of private and public nuisance.

Now, the three parties involved in the lawsuit have reached an agreement, allowing the century-old Forest Hills Stadium to continue operating as long as the venue adheres to agreed-upon conditions. This agreement, with an initial term of seven years, represents all three parties’ commitment to uplifting and supporting the neighborhood of Forest Hills Gardens.

The Terms

Under this new agreement, Forest Hills Stadium will be authorized to host up to 28 concerts per season during the initial term. Tiebreaker Productions, the operator of the stadium, will also provide financial support to the neighborhood of Forest Hills Gardens, which will support FHGC and help with restoration efforts in the neighborhood.

To maintain safety and cleanliness in the neighborhood, Forest Hills Stadium will continue working with the New York Police Department to direct concert guests and minimize traffic disruption in the area during events, as well as maintaining its own security and sanitation forces. Finally, the agreement closes all pending lawsuits among FHGC, WSTC, and Tiebreaker Productions.
